Business Agreement
Zone MassageWorks is a medical massage facility.
I hereby agree to be an independent contractor under the business name of Zone MassageWorks. I agree to carry current, massage therapy liability insurance and NE licensure in order to comply with the requirements and regulations for the state of Nebraska Massage Therapy Board.

Massage Therapy means the physical, mechanical, or electrical manipulation of soft tissue for the therapeutic purposes of enhancing muscle relaxation, reducing stress, improving circulation, or instilling a greater sense of well-being and may include the use of oil, salt glows, heat lamps, and hydrotherapy.

It shall not include diagnosis or treatment or use of procedures for which a license to practice medicine or surgery, chiropractic, or podiatry, is required nor the use of microwave diathermy, shortwave diathermy, ultrasound, transcutaneous electrical nerve stimulation, electrical stimulation of over thirty-five volts, neurological hyperstimulation or spinal and joint adjustments.

Licensure Exceptions: The following are NOT required to obtain a massage therapy license ( pdf icon Statutes Relating to Massage Therapy): 1) Licensed physicians and surgeons, osteopathic physicians, chiropractors, registered nurses, practical nurses, cosmetologists, chiropodists, physical therapists, and barbers who are exclusively engaged in the practice of their respective professions; 2) physicians of the United States Army, Navy, or Public Health Service when acting in the line of duty in this state; and 3) students performing massage therapy services when they render such services within the scope of an approved massage therapy school under the supervision of a licensed massage therapist. 4) Individuals who hold a current license as a massage therapist in another state and who travel with and provide massage therapy services to theatrical groups, entertainers, or athletic organizations.

Reflexology: In order to provide reflexology services, you MUST hold a license to practice massage therapy or a license in another discipline which authorizes such practice.


I agree to provide Zone MassageWorks' management with documentation of school records, current massage licence and proof of liability insurance.
I agree to the pricing structure set forth by Zone MassageWorks and agree to the standard "Non-Compete" contracts set forth according to Zone MassageWorks contract.
This is considered freelance, independent contractor work. All contractors will be given a 1099 IRS tax form which is to be signed along with this agreement.

All client/patient appointments will be scheduled through Zone MassageWorks' Management - No Independent Contractor associated with Zone MassageWorks shall provide his/her private phone numbers, emails, or other contact information with clients/patients served at Zone MassageWorks.

Independent Contractor pricing is as follows:
40% plus tips to independent contractor, tips are not guaranteed; they are at the discretion of the client/consumer.
60% to Zone MassageWorks' Management.

:
$38 Special! 1-hr Intro Massage pays contractor    
$15.20/hr, plus any gratuity provided by customer.

Swedish "Zone Out" Massage 1-hr pays contractor  
$26/hr

Deep Tissue/Medical Massage/Sports Massage        
$30/hr

*Independent contractor will provide his/her own chair/equipment for corporate chair massage and travel expences are not reimbursed by Zone MassageWorks.

GIFT CERTIFICATES:
*$38 1-hr Introductory massage is for first-time patients/clients only.
Not valid for insurance claims, couples massage, duo massages or gift certificates.
Gift certificates issued only for full price massages, sale prices do not apply.
Sale prices do not apply on major holidays or pre-post, standard hours of operation.

Uniform Attire:
ZMW promotes a casual, relaxed "at the beach" atmosphere for everyone.
Must conform to professional standards - clean attire required.
Denim jeans can not be frayed or torn but are permissable.
Capris are permissable in summer months.
Plain Black t-shirts or polo shirts.
All shoes remain at the front lobby - for clients and therapists.
No barefeet during massage sessions - socks or sandles.
Shoe rack is provided in front lobby.

Time Managment for Massage Appointment Scheduling:
All contracted massage therapists will show up 15 minutes prior to scheduled client/patient appointment time.
For "no shows - no calls" - this will not be the responsibility of Zone MassageWorks.
All booked appointments shall have a 15-minute break between each massage in order to better prepare for the next massage.
Bookings are in 30-minute increments.
Lunch breaks are 30-minutes.

TERMS OF DISMISSAL:
Failure to arrive for session - "no call-no show" by therapist.
Any sexual behaviors or conversations with clients while associated and contracted with Zone MassageWorks is cause for immediate dismissal.
Any infraction of the Non-Compete contract is terms for dismissal. 
This contract is not all inclusive of terms for dismissal; Nebraska is an 'at will' state; contract may be terminated at any time at Zone MassageWorks' discretion.

Provided by Zone MassageWorks for Independent Contracted Massage Therapists:
A. Facility/Suites/Utilities
B. Kangen Water - always used at Zone MassageWorks post massage
C. Grapeseed Oil is the standard oil used by this facility. This is a suggested use (due to allergies to "nut" oils) or therapists may utilize Jojoba/Aloe Vera. No Safflower. No peanut oils, almond oil, etc.
For Deep Tissue/Sports massage a Biotone massage lotion is suggested.
D. Heated Table/Memory Foam/Music (or may use personal choice)/Massage Room/one bolster provided and one pregancy pillow provided by Zone MassageWorks.
E. Advertising Expenses including standard Zone MassageWorks' business cards
F. Linens, towels, face covers for cradle must be provided by therapist and laundered at own expense.
G. Barbicide is provided on-site with utility sink for clean up and sanitation of all equipment between massages.
H. Massage therapists shall provide and use:
    1. toothpaste & brush prior to massage session
    2. Deodorant
    3. Sanitize hands
I. Crockpot is provided for use to warm water
J. Aromatherapy will be provided by Zone MassageWorks - exceptions by Zone MassageWorks' permission only.
K. Microwave is provided. Expected to be kept clean and used to warm crock pot, towels, etc.

I am a fully licensed and insured massage therapist under the statutes of NE State Massage Board laws and will provide proof of such to Zone MassageWorks before practicing massage as an independent contractor under the Zone MassageWorks trademarked name. I will also provide proof of current massage therapy liability insurance for the year working.

I agree to the terms set forth in this agreement.
